Blastland AI Legal & Compliance Charter
(Version 10/2025 — applicable to all client collaborations, productions, and communications)
1. General Principles
1.1 This Charter governs all deliveries, services, and AI-assisted creative productions carried out by Blastland (Verein under Swiss Law, CH-UID: CHE-142.944.120, Sennweidstrasse 43, 6312 Steinhausen, Switzerland).
1.2 It unites our General Terms and Conditions (GTC), Privacy Policy, and AI Copyright & Confidentiality Framework into a single binding policy ensuring transparency, ethical conduct, and full legal compliance for all projects.
1.3 Unless otherwise agreed in writing, this Charter forms part of every contract, proposal, or digital interaction between Blastland and the Client.
2. Legal and Ethical Foundation
Blastland complies with all relevant Swiss, EU, and international regulations, including:
Swiss Copyright Act (URG)
Swiss Data Protection Act (revDSG)
EU GDPR (2016/679)
EU AI Act (2024)
EU Directive 2019/790 on Copyright in the Digital Single Market
Berne Convention (WIPO)
All activities are guided by the principles of lawfulness, fairness, transparency, data minimization, and human oversight.
3. Confidentiality and Private-Mode Operations
3.1 All client projects are executed within Private AI Environments, guaranteeing that no data or Client's assets are shared publicly or used for external model training.
3.2 Blastland enforces a following confidentiality structure: Internal NDAs binding all employees and collaborators to operate in private mode on all Client Engagements.
3.3 All project files, references, and AI outputs are encrypted (AES-256) and stored on private drives with restricted access. No client materials are uploaded to public datasets.
4. Copyright and Intellectual Property Governance
4.1 Client-Owned Assets
All materials supplied by the Client (archives, logos, footage, music, text, etc.) remain sole property of the Client.
Blastland uses these assets only as reference material, never as AI training data.
4.2 AI-Generated Materials
All AI-generated outputs are created under human direction. Copyright to final deliverables is transferred exclusively to the Client upon full payment.
Each project includes a Content Authenticity & Traceability Audit (CATA) verifying that no third-party protected material has been used.
4.3 Third-Party References
Any stock or auxiliary media are sourced only from royalty-free, commercial-use libraries (e.g., Epidemic Sound, Artlist, Freepik).
4.4 Work-for-Hire Clause
Unless otherwise stated, all deliverables are deemed works made for hire and belong entirely to the Client.
5. Human Oversight and Ethical Use of AI
Every AI-assisted output is curated, edited, and approved by human creators.
No autonomous or unsupervised AI outputs are published.
Personality rights, trademarks, and likenesses are respected; AI avatars or depictions of individuals are used only with prior written consent.
All AI content adheres to ethical standards of truthfulness, non-bias, and respect for artistic integrity.
6. Data Protection & Privacy (GDPR + Swiss revDSG)
6.1 Blastland collects and processes only the personal data necessary to perform its contractual and organizational duties.
6.2 Legal bases for data processing:

Art. 6(1)(f) GDPR — Legitimate interests of the Verein
6.3 Data subjects have the right to access, rectification, deletion, restriction, objection, and data portability.

6.4 Data is retained only as long as necessary for the stated purposes or legal obligations and then securely deleted.
A deletion certificate can be issued upon Client request.
7. Transparency and Auditability
Every project includes an AI Transparency Report detailing:
AI tools and software used,
type of input data processed,
privacy and data-retention parameters,
authorship attribution,
rights transfer confirmation.
Clients have full access to drafts, logs, and progress materials through a secure shared environment (Microsoft OneDrive or equivalent upon request of the Client).
8. Limitation of AI Use
Client assets are never reused, resold, or repurposed in any AI model or dataset.
Blastland employs AI strictly as a creative and analytical assistant, comparable to digital editing software.
All processes follow the EU AI Act’s “Human-in-the-Loop” compliance model.
9. Liability and Warranties
9.1 Blastland guarantees the integrity, authorship, and originality of the final deliverables it produces and will correct service defects caused by its own actions within a reasonable period after written notice from the Client.
9.2 For material or financial damage caused by ordinary negligence, liability is limited to foreseeable damages and the contract value.
Indirect or consequential losses (e.g., lost profits, operational downtimes, or reputational damages) are excluded.
9.3 Blastland utilizes various licensed third-party AI and creative software tools (e.g., OpenAI, Runway, Midjourney, Adobe, ElevenLabs). These tools are governed by their own end-user license agreements (EULAs). Blastland ensures their legitimate, lawful, and fully licensed use but does not assume liability for the performance, availability, or future functionality of any third-party AI systems or APIs beyond its reasonable control.
10. Branding and Public Representation
All final materials are branded under the Client’s identity.
Blastland may display up to 60-second excerpts (e.g., behind-the-scenes) for its own portfolio only after written Client approval.
No publication, distribution, or social-media post referencing the Client will occur without prior written consent of the Client.
11. AI Ethical and Educational Commitment
A portion of Blastland’s proceeds supports AI education programs for youth in Switzerland, aligned with Microsoft’s and the Swiss Federal Government’s national digital-education mission. This ensures every project contributes to the ethical advancement of AI literacy.
12. Jurisdiction and Applicable Law
12.1 Swiss law applies exclusively; the CISG is excluded.
12.2 Jurisdiction lies with the competent courts at Blastland’s registered business address, Steinhausen, Switzerland.
12.3 Changes or amendments to this Charter must be made in writing.
12.4 If any clause becomes invalid, the remaining provisions remain in force.

Outputs are human-curated derivative works created solely for the Client, guaranteeing 100 % compliance with copyright, data-protection, and brand-integrity laws.
