Blastland AI Legal & Compliance Charter
(Version 07/2027 — applicable to all client collaborations, productions, and communications)
1. General Principles
1.1 This Charter governs all deliveries, services, and AI-assisted creative productions carried out by Blastland, primarily through Blastland Inc. (US HQ: 838 Walker Rd Suite 21-2, Dover, DE 19904, United States), and, where applicable, also through Blastland Verein under Swiss Law (CH-UID: CHE-142.944.120, Sennweidstrasse 43, 6312 Steinhausen, Switzerland) as a secondary Swiss legal structure, depending on the contracting entity, project location, client jurisdiction, and agreed statement of work.
1.2 It unites our General Terms and Conditions (GTC), Privacy Policy, AI Copyright & Confidentiality Framework, and US/EU/Swiss compliance commitments into a single operating policy for transparent, ethical, human-led creative production.
1.3 Unless otherwise agreed in writing, this Charter forms part of every contract, proposal, production brief, delivery, or digital interaction between Blastland and the Client. Client-specific legal requirements may be added by written addendum.
1.4 This Charter is a governance and compliance framework for Blastland operations. It does not replace project-specific legal advice, rights clearance, insurance review, or local counsel review where required.
2. Legal and Ethical Foundation
Blastland designs its work to comply with all relevant Swiss, EU, US, international, and client-local rules, including:
- Swiss Copyright Act (URG)
- Swiss Data Protection Act (revDSG)
- EU GDPR (2016/679)
- EU AI Act (2024), where applicable
- EU Directive 2019/790 on Copyright in the Digital Single Market
- Berne Convention (WIPO)
- US Copyright Act, 17 U.S.C., including the human-authorship principles applied by the US Copyright Office for AI-assisted works
- Digital Millennium Copyright Act (DMCA), including takedown and anti-circumvention requirements where applicable
- Lanham Act / US trademark and unfair-competition rules for brand, logo, endorsement, and source-identification matters
- FTC Act Section 5 and FTC advertising guidance, including rules on unfair or deceptive AI claims, testimonials, endorsements, influencer disclosures, and consumer reviews
- US state privacy laws where applicable, including the California Consumer Privacy Act / CPRA regulations and the Delaware Personal Data Privacy Act
- US CAN-SPAM Act for commercial email communications
- US state biometric, publicity-rights, likeness, voice, deepfake, and synthetic-media laws where applicable
- Colorado Artificial Intelligence Act and similar US state AI laws where a project involves high-risk AI systems or consequential decisions
- NIST AI Risk Management Framework as a voluntary risk-management reference for trustworthy AI governance
- All local standards and law of the prospective Client
All activities are guided by lawfulness, fairness, transparency, data minimization, security by design, rights clearance, human oversight, explainability where feasible, and responsible use of generative AI.
3. Confidentiality and Private-Mode Operations
3.1 All client projects are executed within Private AI Environments, ensuring that client data, source materials, brand assets, archives, footage, music, scripts, prompts, and outputs are not intentionally shared publicly or used for external model training by Blastland.
3.2 Blastland enforces internal confidentiality obligations, NDAs where appropriate, least-privilege access, and private-mode working practices for employees, contractors, and collaborators engaged on Client work.
3.3 Project files, references, and AI outputs are stored in restricted-access environments. Sensitive materials are protected through reasonable technical and organizational measures, including encryption where available, access controls, and segregation of client workspaces.
3.4 Client materials are not uploaded to public datasets by Blastland and are not reused for unrelated clients without prior written permission.
4. Copyright and Intellectual Property Governance
4.1 Client-Owned Assets
All materials supplied by the Client, including archives, logos, footage, music, trademarks, scripts, text, data, likenesses, and brand guidelines, remain the Client's property or the property of the relevant rights holder. Blastland uses these materials only for the approved project scope.
4.2 AI-Assisted and AI-Generated Materials
Blastland creates AI-assisted outputs under human direction, selection, editing, arrangement, and approval. For US projects, Blastland follows the principle that copyright protection depends on protectable human authorship and that purely machine-generated material may not be independently copyrightable.
To the extent legally transferable and unless otherwise agreed, Blastland assigns or licenses final approved deliverables to the Client upon full payment, subject to third-party licenses, platform terms, pre-existing materials, open-source terms, and any rights that cannot be assigned by law.
Each project may include a Content Authenticity & Traceability Audit (CATA) documenting principal inputs, AI tools, human creative decisions, rights assumptions, and known third-party dependencies.
4.3 Third-Party References
Stock, music, fonts, models, templates, and auxiliary media are sourced from licensed, royalty-free, commercial-use, client-provided, or otherwise rights-cleared sources whenever required. Use of famous persons, brands, characters, music, logos, or protected works requires written clearance, public-domain confirmation, licensed use, or a documented legal basis.
4.4 Work-for-Hire and Assignment
Where US law applies and where expressly stated in the contract, eligible deliverables may be treated as works made for hire. If a deliverable does not legally qualify as work made for hire, Blastland will provide an assignment or license of its transferable rights as set out in the applicable agreement.
4.5 DMCA and Rights Complaints
Blastland responds to good-faith copyright, trademark, publicity-rights, or privacy complaints and will review, remove, replace, or correct disputed materials where legally required or commercially reasonable.
5. Human Oversight and Ethical Use of AI
Every AI-assisted output is curated, edited, and approved by human creators before delivery or publication.
No autonomous or unsupervised AI outputs are knowingly published as final client work.
Personality rights, trademarks, voice, image, likeness, and publicity rights are respected. AI avatars, voice clones, synthetic performances, or depictions of real individuals require consent, license, or a documented legal basis.
Blastland avoids deceptive deepfakes, misleading political or commercial impersonations, undisclosed paid endorsements, fake reviews, and AI claims that overstate system capability, originality, safety, legality, or guaranteed results.
Blastland does not knowingly deploy high-risk AI systems to make consequential decisions in employment, credit, education, housing, insurance, healthcare, criminal justice, or similar regulated domains without a separate risk assessment, legal review, and client-approved compliance addendum.
6. Data Protection & Privacy (GDPR + Swiss revDSG + US Privacy Laws)
6.1 Blastland collects and processes only personal data reasonably necessary to perform contractual, creative, organizational, security, and communication duties.
6.2 Legal bases and compliance mechanisms may include:
- Art. 6(1)(a) GDPR — Consent
- Art. 6(1)(b) GDPR — Contract performance
- Art. 6(1)(c) GDPR — Legal obligation
- Art. 6(1)(f) GDPR — Legitimate interests of Blastland or the Client
- Swiss revDSG principles of proportionality, transparency, purpose limitation, and data security
- Applicable US state privacy obligations, including notice, access, deletion, correction, portability, opt-out, sensitive-data, and appeal rights where triggered
6.3 Data subjects may request access, rectification, deletion, restriction, objection, portability, or other rights available under applicable law. Requests can be addressed to elebedinskaya@blastland.net or kmarzohl@blastland.net.
6.4 Data is retained only as long as necessary for the stated purposes, project documentation, rights audit, accounting, legal defense, security, and statutory obligations, and is then deleted or anonymized. A deletion certificate can be issued upon Client request where technically and legally feasible.
6.5 For US users and clients, Blastland does not sell personal information as a business model. If a project introduces advertising, analytics, cross-context behavioral advertising, sensitive personal information, or biometric/voice data processing, Blastland will implement the notices, opt-outs, consents, and contractual safeguards required by applicable US state law.
6.6 Blastland applies reasonable administrative, technical, and organizational safeguards and will handle security incidents according to applicable breach-notification laws and contractual obligations.
7. Transparency and Auditability
Every project may include an AI Transparency Report or production memo detailing:
- AI tools and software used,
- type of input data processed,
- privacy and data-retention parameters,
- human creative contribution and approval steps,
- authorship attribution and rights-transfer assumptions,
- third-party licenses, restrictions, and known clearance dependencies,
- risk controls for synthetic media, likenesses, trademarks, and regulated use cases.
Clients have access to agreed drafts, logs, and progress materials through a secure shared environment such as Microsoft OneDrive or an equivalent workspace upon request.
8. Limitation of AI Use
Client assets are not reused, resold, or repurposed in any AI model or dataset by Blastland.
Blastland employs AI strictly as a creative, analytical, and production assistant comparable to digital editing, sound, design, and post-production software, with human direction and quality control.
Blastland follows the EU AI Act's human-in-the-loop approach where applicable and uses the NIST AI Risk Management Framework as a voluntary reference for mapping, measuring, managing, and governing AI-related risk.
9. Advertising, Endorsements, Influencers, and Public Claims
9.1 Any marketing, influencer, celebrity, testimonial, or social-media content created for US audiences must comply with FTC truth-in-advertising principles, including clear disclosure of material connections, sponsorships, paid partnerships, free products, or other incentives.
9.2 Blastland does not knowingly create fake consumer reviews, fake testimonials, undisclosed endorsements, deceptive rankings, or fabricated social proof.
9.3 AI-related claims must be accurate, supportable, and not misleading. Blastland will not claim that AI tools or outputs are uniquely capable, legally risk-free, unbiased, fully autonomous, or guaranteed unless such claims are documented and approved.
10. Liability and Warranties
10.1 Blastland will use commercially reasonable efforts to deliver original, human-curated work consistent with the approved brief and will correct service defects caused by its own actions within a reasonable period after written notice from the Client.
10.2 The Client is responsible for confirming the accuracy of factual claims, regulated claims, product claims, medical/financial/legal statements, mandatory disclaimers, and any client-provided assets or approvals.
10.3 For material or financial damage caused by ordinary negligence, liability is limited to foreseeable damages and the contract value, unless mandatory law provides otherwise. Indirect or consequential losses such as lost profits, operational downtimes, reputational damages, or platform takedowns are excluded to the maximum extent permitted by law.
10.4 Blastland utilizes licensed third-party AI and creative software tools, including OpenAI, Claude, Runway, Midjourney, Adobe, ElevenLabs, Seedance, Kling, and similar providers. These tools are governed by their own end-user license agreements, platform terms, privacy terms, and availability conditions. Blastland ensures lawful and licensed use to the best of its knowledge but does not assume liability for third-party system performance, availability, training practices, policy changes, or future functionality beyond its reasonable control.
11. Branding and Public Representation
All final materials are branded under the Client's identity unless otherwise agreed.
Blastland may display up to 60-second excerpts, behind-the-scenes materials, still frames, or project summaries for its own portfolio only after written Client approval.
No publication, distribution, press release, social-media post, or public case study referencing the Client will occur without prior written consent of the Client.
12. AI Ethical and Educational Commitment
A portion of Blastland's proceeds supports AI education programs for youth and creators, aligned with responsible digital-education principles. This ensures that client work contributes to ethical AI literacy, creative empowerment, and human-centered technology adoption.
13. Jurisdiction and Applicable Law
13.1 Unless otherwise agreed in a signed contract, Swiss law applies to work contracted through Blastland Verein, and Delaware/US law may apply to work contracted through Blastland Inc. The CISG is excluded where legally possible.
13.2 Jurisdiction and venue are determined by the contracting entity and the applicable agreement. In the absence of a separate written agreement, the competent courts at the relevant Blastland registered business address apply to the extent permitted by law.
13.3 Mandatory consumer, privacy, employment, intellectual-property, and platform rules remain unaffected.
13.4 Changes or amendments to this Charter must be made in writing.
13.5 If any clause becomes invalid, the remaining provisions remain in force.

All AI activities undertaken by Blastland are designed to take place in secure, private environments so that Client copyrighted materials, confidential assets, and brand information remain isolated from public datasets and unrelated client work.
Outputs are human-directed and human-curated creative works prepared for the Client, with compliance controls designed to support copyright, data-protection, publicity-rights, advertising, and brand-integrity obligations across Switzerland, the EU, the United States, and the Client's local market.
